Recently CWC deal the cases of 18+,we are confused in the sessions what will do  in these cases.Because,

1.some girl child/persons not willing to go with her parents.
2.Some of asking go with her boyfriends or other persons.

If they are child, below the age of 18 years we will hand over/restore their biological parents/relatives. DCPU / Shelter homes people pressuring me to restore these type of cases immediately. So, Please clarify the doubts to take right decisions in future.

STOP CHILD MARRIAGE

Query No 1:
A 15 years old girl has been rescued from Child marriage and produced before CWC. The CWC has referred the girl to a shelter home for temporary accommodation along with care and protection services. After a while, it is come to know that the girl is already a pregnant of 6th month. In these circumstances, police people asking, under which Act and Sections case could be filed in absence of the accused person? In which home the girl could be kept for further services after realizing about her pregnancy?
Clarification:
A Case can be filed against accused person even in the case of his absence under POCSO Act, 2012. A statement of the girl under 164 (5) Cr. PC by CWC or by a Judicial magistrate should be recorded to know more comprehensive details of the case background. The victim girl should be referred to medical examination to know the intensity of sexual abuse and status of pregnancy.
As per JJ (Care and Protection of Children) Act, 2000 amend 2006, there are no specific homes exclusively for the purpose of pregnants. The victim girls with pregnancy could also be accommodated in normal children homes recognized by the concerned department but could be provided with special medical care and services as and when it is required.
Query No 2:
Do the CWC could refer the children in need of care and protection to the homes recognized as fit institutions and also to the homes approved under licensing Act of Dept of Women Development and Child Welfare?
Clarification:

Yes. CWC could refer the CNCP to any institutions recognized by the Govt as fit institutions either by the Dept of Juvenile Welfare or by the Dept of Women Development and Child Welfare.

The Child Welfare Committee as per Section 29(5) of the Juvenile Justice (Care & Protection of Children) Act, 2000, amend 2006 is a statutory authority constituted by the Govt. of AP and functioning as a Bench of Magistrates with powers of Judicial Magistrates of the First class.  The Child Welfare Committee (hereinafter CWC) under the Act is the final authority to dispose of cases concerning children (not completed 18 years of age) in need of care and protection in terms of their development, care, treatment and rehabilitation. The CWC is also empowered to inquire into offences committed against children.

Whereas the Child Welfare Committee of Prakasam district is hereby examined the case of minor girl named as xxxxxxx, aged 17 years D/o xxxxxxxxxx (late) of xxxxxxxx village of xxxxxxxx mandal of Prakasam district who has been worked as a domestic labor in your home. It is came to know as per the statement of said victim girl xxxxxxx and her nearest relative (maternal uncle) Mr. xxxxxx that, you have committed sexual abuse and exploitation and raped the girl and caused for her pregnancy.

A criminal case has also been booked against you under Sec 312 IPC and Sec 4 of POCSO Act, 2012 with FIR No 207/2013 on 4/11/2013 in Maddipadu Police Station the case was brought to the presence of CWC and the victimized girl has also been produced before it.

As per Sec 11 of Juvenile Justice Act, 2000, amend 2006 any person in whose charge a juvenile is placed and is affected physically or sexually or in any other manner which harms the childhood of such child shall be responsible for his/her maintenance. But, you have utterly failed in providing proper care & protection to the said girl child.

 the CWC is hereby instructed through exercising the powers conferred under Sec 31 of JJ Act 2000, amend 2006 to pay a compensation of Rs. 5 Lakh (rupees five lakhs only) by treating the victim girl as a “child in need of care and protection” under Sec 2(d) (vi) of JJ Act, 2000 amend 2006 who is being or is likely to be grossly abused, tortured or exploited for the purpose of sexual abuse or illegal acts. The compensation shall be paid within a period of 1 month in the best interest of the children and in case of any of the failure of executing the instructions by CWC you are legally  liable under Sec 28 of JJ Act 2000 amend 2006 where an act or omission constitute an offence punishable under this Act and also under any other Central or State Act, then, notwithstanding anything contained in any law for the time being in force, the offender found guilty of such offences shall be liable to punishment only under such Act as provides for punishment which is greater in degree.
The CWC is further determined the age of said victim girl Purini Lakshmi is in between 16-17 years under Sec 49(2) of JJ Act 2000, amend 2006 that, no order of a competent authority shall be deemed to have become invalid merely by any subsequent proof that the person in respect of whom the order has been made is not a juvenile or the child, and the age recorded by the competent authority to be the age of person so brought before it, shall for the purpose of this Act, be deemed to be the true age of that person.

-          The CWC is has directed to the Project Director of dist Women & child development agency to transfer the said girl Purini Lakshmi to the Govt Girls home – Tirupathi for safe custody in the best interest of the child through the proceedings with RC No: CWC/PRK/1202/2014 on 12th Feb 2014, But no necessary steps have been taken by the said authorities till date. So the CWC is hereby again instructed to execute the above instructions and transfer the girl immediately to Tirupathi home.
 The CWC is further directed concerned Mandal Revenue Officer of Maddipadu mandalto take necessary action against the perpetrator so as to make him to pay the above cited compensation to the victim girl within the time period prescribed by the CWC.

-        The CWC is hereby instructed DCPO of DCPU to make proper follow up with all the concerned authorities and coordinate with them so as to execute these proceedings without any deviation and delay beyond the time period given through this issued proceedings.

Operation Muskaan అనేది బాలలకు సంభంచిన అంశం. ఈ అంశం భారతదేశం అంతటా వర్తిస్తుంది.  ఈ ప్రత్యేక ఆపరేషన్ జరుపమని అన్ని రాష్ట్రాలకు, కేంద్రపాలిత ప్రాంతాలకు భారత సుప్రీమ్ కోర్ట్ వారు ఆదేశాలు జారీ చేయడం జరిగింది. అందుకు సంభంచి Home Secretary, Government of India నుండి DO No. 15011/992014-ATC, dt. 19th. Thanks for getting this information. This is very helpful. Just one query - I understand that …" Sub-Inspectors, Head Constables and Constables including Women officers may ASSIST the Inspector of Police to conduct/rescue i.e.to say that the Subordinate staff will be witnesses for the raid and rescue.  and, when the Inspector of Police is busy, he may as per section 14(ii) of ITP Act, authorise Subordinate officer to conduct raid/rescue.  In exceptional cases, the S.I.of Police, who is specially authorised by the Special Police officer(by phone/SMS/General diary entry) he may conduct the rescue/raid to prevent loss of valuable evidence/destruction/concealment of evidence". 

Does this also imply that Inspector of Police may be assisted by an SI to investigate the crime? Let me explain the situation in West Bengal. 

We find that FIRs lodged when trafficked victims are rescued in Mumbai or Pune by the Maharashtra only indict brothel managers, pimps or in rare cases brothel owners, but do not indict traffickers from the source area. For example: if a victim has been trafficked from West Bengal or Orissa, the FIR or charge-sheet does not indict the trafficker from West Bengal, who was responsible for procuring and transporting the victim. The reason is that the Maharashtra police finds it difficult to conduct investigation in another state, and since expenses incurred is reimbursed to the investigating officer post facto sometimes taking over two years, it is disincentive for the police. In their experience, since the investigation of trafficker/s in another state is more difficult and suffers, sometimes the cases against the brothel manager or owner also gets spoilt, so they focus on the culprits within their jurisdiction. 

We find that when survivors return home, they often find the trafficker/s who had recruited and transported them to the destination state, is at large and free. A few of these survivors file FIRs against them. The WB police insists on not using ITPA in these cases, even when victims produce FIR copies that were lodged in Maharashtra which proves that these victims were rescued from commercial sexual exploitation. The reason is that WB suffers a shortage of inspectors (over 50% according to the CID, West Bengal). it is at this time I remember having read the document that Umapathi-ji has forwarded. My question here is - does the order that was passed in AP, also therefore may imply that SIs may assist the Inspectors in investigation of a case? 

I would be obliged if Umapathi-ji could offer his perspective. I am attaching a copy of the research report in which all of the above is more clearly illustrated.

 Good afternoon! This is Uma Chatterjee from  SANJOG kolkata...hope you and the entire team at HELP are
 fine and well. 
 Mr. Ramamohan,am writing this mail for a favour.  I have heard that there is an official GR passed by the AP
 government which authorizes Sub-inspector level (SI) police  officers to be given the charge as Special officers to  investigate ITPA cases. The reason this was passed was  because of the inadequate number of Inspectors in the State.
 Is this something correct, Ramamohan ji? If yes, will it be  possible for you to share a copy f that GR/GO with
 us.
 In west Bengal we have a similar situation and  one of the reasons for poor ITPA application in the villages
 and districts of west bengal is that there no Inspector  level police officers available at that level. This is
 causing huge injustice for survivors and we would like to  lobby for this. 

 If there is such a precedence in AP, then this  will further strengthen our case with the Department of Home
 here.

Dear Ram Mohan,


As per sec.13(2) of I.T.P.Act, the Special Police officers shall be of the rank of Inspectors of Police(Act 46 of 1978) and accordingly, A.P.government have issued the G.O.in 1991, vide G.O.Ms.No.475, (Home Pol-D) Department dt. 16-8-1991 appointing Asst.Commissioners of Police and Inspectors of Police as Special Police officers. However, the A.P.Government, have also appointed Sub-Inspectors, Head Constables and Constables including Women officers to ASSIST the Inspector of Police to conduct/rescue i.e.to say that the Subordinate staff will be witnesses for the raid and rescue. 


However, when the Inspector of Police is busy, he may as per section 14(ii) of ITP Act, authorise Subordinate officer to conduct raid/rescue.  In exceptional cases, the S.I.of Police, who is specially authorised by the Special Police officer(by phone/SMS/General diary entry) he may conduct the rescue?raid to prevent loss of valuable evidence/destruction/concealment of evidence.


 In any case the S.I.of Police has to send a report to the Inspector of Police, i.e.Special Police officer.
As of now, no amendment was issued by the A.P.Government, appointing S.I.of Police as Special Police officer.  Unless, the Original ITP Act, Sec.13(2) is amended, no such appointment can be issued by the State Government.

భావించండి. Cr. Pc. 164 (A) ప్రకారం బాదితులను వెంటనే వైద్య పరిక్షలకు
పంపించాలి. Police Station లో FIR బుక్ అయిన అనంతరం ఒక కాపీని బాదితురాలికి
అందేలా చేయండి.  ఇతర విషయాలకు POCSO చట్టం 2012 లను పరీక్షించండి.

మా జిల్లాలో 16 Years బాలుడు 7 Years బాలిక పై లైంగిక వేదింపు చేచినాడు ఈ కేసు కు  సంబంధించి  పోలీస్  వారు  FIR లో POCSO Act  అండర్ సెక్షన్ 4 నమోదు చేచి JJB ముందు ప్రవేశ పెట్టగా ,JJB ఆ బాలుడుని హోం లో పెట్టినారు .అయితే ఒక నెల తరువాత బెయిలు తెచుకొని బయటికి వచ్చి ఆ బాలుడు మరల ఆ బాలికను వేదించటం మొదలుపెట్టినాడు అయితే ఈ కేసు కు సంబంధించి ఏమి చెయ్యాలో తెలపగలరు  .

అప్పజెప్పటం సంతోషకరం. బాలికను Home Integration జరిపినప్పుడు మీరు ఉపయోగించిన
Proceeding copy ని Xerox చేసి Police Station కు పంపించండి. ఆ Xerox copy
వారికి Acknowledgement అవుతుంది. ఈ కేసు విషయంలో DPO/DCPU లేదా బాలల కొరకు పని
చేస్తున్న స్వచ్చంద సంస్థలచే Social Enquiry చేయించండి. Enquiry Report ప్రకారం
అవసరమైన రక్షణ సంరక్షణల ను మీ పరిధిలో అందించండి.  అనంతరం పాప విషయాలు కొన్ని
రోజులు సమీక్షించాలంటే DPO/DCPU లేదా బాలల కొరకు పని చేస్తున్న స్వచ్చంద
సంస్థలకు CWC నుండి ORDER జారీ చూస్తూ దశల వారీ రిపోర్ట్ లను అందించమని అడగండి.

మీరు తెలియజేసిన 12 సంవత్సరాల మైనరు బాలిక కేసు వివరాల ప్రకారం. మొదటvictim యొక్క ఆరోగ్య పరిస్తితుల నిమిత్తం Medical Check-up చేయించండి. గర్బిణీ అయినట్లయితే Doctor సలహా మేరకు abortion విషయం ఆలోచించండి. వీటన్నిటికి పూర్వం child యొక్క వివరాలు రిజిస్టర్ చెయ్యాలి. అనగా Cr. Pc. 164 (5) ప్రకారం Statement Recording జరిగిన, భవిష్యత్ లో కేసుకు తగిన ఆధారాలు లబ్యమౌతాయి.  అనంతరం local Police Station లో POCSO Case క్రింద  Register చేయించండి.  . గతంలో ఒకసారి ఒక వ్యక్తిచేత మోసగించబడి case Register కాబడినప్పటికి, ఇప్పుడు మరొక వ్యక్తి చేత మోసగించబడినందున మరో సారి, మరొక కేసుగా కూడా register చేయవచ్చును.   ఆ కేసును ప్రకాశం జిల్లాకు Transfer చేయండి, ఇక్కడ ఆ విషయాన్ని బట్టి కావాల్సిన ఇతర విషయాలు చేయడం వీలవుతుంది. విద్య, వసతి మొదలైన విషయాలపై తగిన నిర్ణయం చేయండి.
